PLAYSWEEPS, LLC (the “Sponsor“ or “PLAYSWEEPS”) operates an online platform that offers Participants the opportunity to engage in entertaining gaming experiences. Additionally, Sponsor gives away sweepstakes entries referred to as “Sweeps Coins” as detailed below. These Sweeps Coins can be used to play sweepstakes games for a chance to win additional Sweeps Coins and to accumulate eligible Sweeps Coins that can be redeemed for prizes or items of real-world value, subject to the terms of these Official Rules.

NO PURCHASE OR PAYMENT OF ANY KIND IS REQUIRED TO ENTER UNDER ANY METHOD OF ENTRY OR TO WIN OR CLAIM PRIZES. AN ENTRY OBTAINED AS A FREE BONUS IN CONNECTION WITH A PURCHASE OR PAYMENT WILL NOT INCREASE OR IMPROVE YOUR CHANCES OF WINNING OVER AN ENTRY OBTAINED WITHOUT ANY PURCHASE OR PAYMENT.  BY ENTERING, YOU AGREE TO THESE OFFICIAL RULES, WHICH ARE A CONTRACT, SO READ THEM CAREFULLY BEFORE ENTERING. WITHOUT LIMITATION, THIS CONTRACT INCLUDES INDEMNITIES FROM YOU AND A LIMITATION OF YOUR RIGHTS AND REMEDIES.

THESE OFFICIAL RULES CONTAIN AN ARBITRATION AGREEMENT, WHICH REQUIRES, TO THE EXTENT PERMITTED BY LAW, THAT ALL DISPUTES BE RESOLVED SOLELY BY BINDING ARBITRATION, AND PARTICIPANTS AGREE TO ONLY PURSUE CLAIMS AGAINST SPONSOR AND ITS AFFILIATES AND/OR SEEK RELIEF ON AN INDIVIDUAL BASIS, AND PARTICIPANTS WAIVE THE ABILITY TO BRING CLAIMS IN A CLASS ACTION FORMAT, OR AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION OR PROCEEDING.


1.        RULES:

 

1.1.    The Sweepstakes shall be governed by these Official Rules. By entering, all Participants agree to be fully and unconditionally bound by these Official Rules and the decisions of the Sponsor, whose decisions shall be final and binding in all respects.

1.2.    The Sweepstakes is subject to applicable federal, state, provincial, territorial and local laws any other applicable law of any entrant’s country of residence and regulations and is VOID WHERE PROHIBITED OR RESTRICTED BY LAW. 

1.3.    Winning and receiving a Prize is contingent upon fulfilling all requirements set forth herein.

1.4.   Each Sweepstakes starts at the beginning of each spin in Sweeps Play and ends at the conclusion of that spin. Each spin is a separate Sweepstakes.

 

2.        FACEBOOK®, INSTAGRAM, TWITTER, APPLE, GOOGLE, AND AMAZON DISCLAIMER: Entrant agrees and acknowledges, as a condition of participating in the Sweepstakes, that Facebook® Inc., Instagram, LLC, Twitter, Inc., Apple Inc., Google LLC, or Amazon.com, Inc. and their owners, directors, officers, employees, contractors, agents, representatives, parents, subsidiaries, attorneys, insurers, and associated corporations and entities (individually and collectively referred to herein as the “Social Networking Sites” or “SNS“) do not sponsor, endorse, or administer, nor are they in any way associated with, the Sweepstakes. As a condition of participating in the Sweepstakes, entrant further acknowledges and agrees that entrant shall release the SNS from any and all liability arising out of or relating to entrant’s participation in the Sweepstakes, or entrant’s acceptance, use, or misuse of a Prize. All questions regarding the Sweepstakes must be directed to Sponsor, not SNS.
 

3.        DEFINITIONS:  Capitalized terms not defined in these Official Rules will have the meanings ascribed to them in the PLAYSWEEPS Terms of Service found HERE.
 

3.1.    Game or Games mean the social casino style games available for play at www.thewinzone.com.

3.2.    Gold Coins means the virtual gameplay token that enables a Participant to play the Games in Standard Social Gameplay mode. Gold Coins have no monetary value and cannot under any circumstance be redeemed for prizes

3.3.    Participant (or “you”) means any person who plays any Games or uses the PLAYSWEEPS Platform in any manner, whether through Standard Social Gameplay mode or Sweeps Play mode.

3.4.    Registered Player means a Player who completes registration of a Player Account.

3.5.    Player Account means an account held by a Registered Player.

3.6.    PLAYSWEEPS Platform means the services provided through any URL or mobile application belonging to, or licensed to, PLAYSWEEPS, LLC, that provide access to, and use of, the Games, in Standard Social Gameplay mode and Sweeps Play mode.

3.7.    Standard Social Gameplay means gameplay in which only Gold Coins can be used.

3.8.    Sweeps Coins means the sweepstakes entries subject to these Official Rules that enable a Participant to play the Games in Sweeps Play mode.

3.9.    Sweeps Play means participating in sweepstakes in gameplay in which only Sweeps Coins may be used.

 

4.        ELIGIBILITY:  
 

4.1.    The sweepstakes is only open to Participants with a valid Player Account and who are legal residents (individuals who are the majority age in their state (for U.S. residents), but in no case under the age of twenty-one (21)) of the fifty (50) United States (excluding Connecticut, Idaho, Michigan, Montana, Nebraska, Nevada, North Dakota, and Washington). PARTICIPATION IS VOID WHERE PROHIBITED BY LAW.

4.2.    Participation is void in the states of Connecticut, Idaho, Michigan, Montana, Nebraska, Nevada, North Dakota and Washington, as well as any outlying U.S. territories or possessions, and any other jurisdiction outside of the United States.

4.3.    Owners, officers, directors, members, managers, employees, representatives, and agents of Sponsor and each of its respective parent companies, affiliates, subsidiaries, franchisees, partners, fulfillment agencies, and any other companies associated with the design or execution of the Sweepstakes, including, any prize provider, (individually and collectively referred to herein as the “Sponsor Affiliates”), as well as each of their Immediate Family Members, as defined below, and Household Members, as defined below, are not eligible to participate in or win the Sweepstakes. “Immediate Family Members” shall mean spouse, parents, stepparents, legal guardians, children, stepchildren, siblings or stepsiblings and each of their spouses regardless of where they reside. “Household Members” shall mean those people who share the same residence at least three (3) months a year.

4.4.    Winning a Prize is contingent upon fulfilling all requirements set out in these Official Rules and the Terms of Use.

4.5.    In the event of a dispute as to the ownership of any Sweeps Coins, the authorized account holder of the email address used to register the Player Account will be deemed to be the Participant. The “authorized account holder” is the person assigned the email address by an internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address.

4.6.    PLAYSWEEPS’ decisions as to the administration and operation of Sweeps Play are final and binding.

 

5.         HOW TO ENTER THE PLAYSWEEPS SWEEPSTAKES
 

5.1.   NO PURCHASE OR PAYMENT OF ANY KIND IS REQUIRED TO ENTER UNDER ANY METHOD OF ENTRY OR TO WIN OR CLAIM PRIZES. AN ENTRY OBTAINED AS A FREE BONUS IN CONNECTION WITH A PURCHASE OR PAYMENT WILL NOT INCREASE OR IMPROVE YOUR CHANCES OF WINNING OVER AN ENTRY OBTAINED WITHOUT ANY PURCHASE OR PAYMENT.

5.2.    To participate, you must have an active Player Account. If you do not have a Player Account, you can create one for free at https://thewinzone.com. Participants with an active Player Account and who meet eligibility requirements must access the PLAYSWEEPS Platform at https://thewinzone.com and sign in to their Player Account in order to collect Sweeps Coins.
 
5.3.    The PLAYSWEEPS Platform offers two modes of game play: (1) Standard Social Gameplay in which only “Game Coins” may be used for game play, and (2) Sweeps Play, in which only “Sweeps Coins” may be used for game play. Participants will be able to select which mode of game play to play games on the PLAYSWEEPS Platform.
 
5.4.    To access Sweeps Play, a Participant must open the PLAYSWEEPS Platform and click on the button next to their Sweeps Coins balance that reads “Sweeps.” The Participant will then be redirected to the Sweeps Play mode.
 
5.5.    When Participants play games in Sweeps Play mode, they will play games using Sweeps Coins for the chance to win further Sweeps Coins, which will be redeemable for real prizes and/or real cash. Sweeps Coins may be obtained in numerous ways described below. NO PURCHASE OR PAYMENT OF ANY KIND IS REQUIRED TO OBTAIN SWEEPS COINS. A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING.

5.6.    Eligible Participants who access the PLAYSWEEPS Platform may obtain free Sweeps Coins in any of the following ways:

 

5.6.1.         By Logging on to PLAYSWEEPS: A Participant will be awarded a set amount of free Sweeps Coins the first time they log on to their PLAYSWEEPS Player Account each day (“Daily Bonus”). To create a Player Account, Participants may visit  http://thewinzone.com and follow the required steps. Player Accounts are free to create. Only one (1) Player Account is allowed per Participant. The number of Sweeps Coins to be allocated to Participants as a Daily Bonus can be changed at any time by PLAYSWEEPS in its sole discretion. To claim a Daily Bonus, Participants must meet all eligibility requirements and follow all required steps, as specified on the PLAYSWEEPS Platform.  Participants can claim a Daily Bonus only once per each 24-hour period.

5.6.2.         As a Bonus to Purchasing Gold Coins for your PLAYSWEEPS Player Account: Participants may obtain free Sweeps Coins as a bonus for purchasing specifically marked Gold Coins for their Player Account. The amount of free Sweeps Coins awarded as a bonus for each specifically marked Gold Coins purchase will be displayed at the time of purchase. All purchases of Gold Coins are final and no refunds will be given. The number of Sweeps Coins to be allocated to Participants can be changed at any time by PLAYSWEEPS in its sole discretion.

5.6.3.         Alternate Method of Entry: Participants can receive free Sweeps Coins by sending a request card by post. Participants wishing to do so must send a standard postcard or blank piece of paper made to size (“Request Card”) which must be 4” x 6”, unfolded and placed inside a stamped #10 envelope addressed in handwriting, to the following address and satisfying the requirements set out below, including a unique Mail-In Request Code described below:

Their unique Mail-In Request Code generated to their PLAYSWEEPS Player Account while logged on to the PLAYSWEEPS Platform in the following format: XXXXX-XXXXX-XXXXXXXXX. Any other format will be invalid. (instructions on how to obtain the Mail-In Request Code are below)
 

Legibly handwrite the following, in landscape layout, on only one side of the Request Card inserted inside the envelope IN THE FOLLOWING ORDER:
 

On the Top Left of the card:

  • Their full name as shown on their PLAYSWEEPS Player Account

  • The email address registered to their PLAYSWEEPS Player Account;

  • Their unique Mail-In Request Code generated to their PLAYSWEEPS Player Account while logged on to the PLAYSWEEPS Platform in the following format: XXXXX-XXXXX-XXXXXXXXX (any other format will be invalid; instructions on how to obtain the Mail-In Request Code are below);

  • The return/residential address on their Government ID associated with their PLAYSWEEPS Player Account.

 
On the Top Right of the card:

  • The date on which the letter was prepared by the Player.

 
Additionally on the Front Side of the Request Card, the Player must then write the following statement below the above information:
 

"I wish to receive Sweeps Coins to participate in Sweeps Play on THEWINZONE."
 

FOR THE AVOIDANCE OF DOUBT, COMBINED REQUESTS SENT VIA PACKAGE OR PARCEL DO NOT MEET THE REQUIREMENTS SET OUT ABOVE AND ARE INVALID.
 

5.7.    Mail-In Request Code: In order for a Request Card to be processed and deemed valid, it must possess a unique Mail-In Request Code. Participants may obtain a Mail-In Request Code by following these steps:
 

5.7.1.        Log in to your PLAYSWEEPS Player Account;

5.7.2.       Once logged in, click on the “Sweepstakes Rules” at the bottom of the home page of the website at https://www.thewinzone.com;

5.7.3.       Click HERE to obtain Your Mail-In Request Code; and

5.7.4.       Follow the prompts.

 

The Participant must write the Mail-In Request Code on the outer envelope (as described above) in the following format: XXXXX-XXXXX-XXXXXXXXX. The purpose of the Mail-In Request Code is to assist PLAYSWEEPS with the efficient, effective, and timely processing of a Participant’s Request Card. A POSTAL REQUEST CARD MAY ONLY BE USED ONCE and may only be used by the Participant whose PLAYSWEEPS Player Account was used to generate the Mail-In Request Code. Any person suspected by PLAYSWEEPS to have either directly or indirectly provided or received a Mail-In Request Code of another Participant may, in PLAYSWEEPS’s sole discretion, be disqualified from PLAYSWEEPS Sweeps Play and may risk suspension or termination of their PLAYSWEEPS Player Account.
 

MAIL-IN REQUEST CODES ARE VALID FOR 60 DAYS AFTER THEY ARE GENERATED.
 

5.8.    There is a limit of one request per outer envelope. For each Request Card a Participant submits in accordance with the above requirement, the Participant will receive four (4) Sweeps Coins. The Sweeps Coins will be added to the Participant's PLAYSWEEPS Player Account within a reasonable amount of time after the Request Card is  received by PLAYSWEEPS in the mail and validated.
 
5.9.    A Participant must ensure that their handwriting is legible. If the Participant's handwriting is not legible, as determined in our sole discretion, the Request Card will be deemed invalid and no Sweeps Coins will be added to the Participant's PLAYSWEEPS Player Account. Additionally, all required information must be written in one color of ink (Black ink is recommended). The use of multiple colors will result in the Request Card being deemed invalid. Failure to comply with any of the requirements set out in this Section will result in the applicable Request Card being deemed invalid.
 
5.10.    A Request Card may only be submitted by the Participant. The name written on the Request Card must match the name associated with the PLAYSWEEPS Player Account listed on the Request Card. If the name provided to PLAYSWEEPS upon registration of the PLAYSWEEPS Player Account is different from the name on the Request Card, the Request Card will be deemed invalid and the Participant must submit a request to change the name associated with their PLAYSWEEPS Player Account.

5.11.  Tampering with the entry process or the operation of PLAYSWEEPS Sweeps Play, including but not limited to the use of any device to automate the Sweeps Coins entry process or to unfairly assist the Participant with meeting the handwritten requirement, is prohibited and any Request Cards deemed by PLAYSWEEPS, in its sole discretion, to have been submitted in this manner will be deemed invalid. If PLAYSWEEPS discovers or suspects that a Participant has tampered with the AMOE Request Card process, is outsourcing the drafting of Request Cards, or is manipulating Request Card entries, will result in their Request Cards being deemed invalid and their PLAYSWEEPS Player Account may be suspended or cancelled, in PLAYSWEEPS sole discretion.
 
5.12.   In the event a dispute regarding the identity of the Participant who has submitted a Request Card, or whether a Request Card satisfies the requirements set out above, cannot be resolved to PLAYSWEEPS's satisfaction, the relevant Request Card will be deemed invalid.
 
5.13.   PLAYSWEEPS is not responsible for lost, late, incomplete, invalid, illegible, or misdirected Request Cards or Sweeps Coins allocations
 
5.14.   PLAYSWEEPS reserves the right to add other methods or alter the above methods of obtaining Sweeps Coins from time to time. PLAYSWEEPS will allow for a grace period for those Request Cards already in the mail but not received by PLAYSWEEPS before any update to these Official Rules. All dates will be cross-referenced to the initial date written on the Request Card and the postage date. If it is determined that the Participant has tampered with the initial date written on the Request Card or with the postage date, the Request Card will be deemed invalid. Any Request Card received after the grace period expires will be reviewed in accordance with the updated Official Rules.

5.15.   Please note the following rules regarding AMOE Request Card submissions, which if not followed, could result in the suspension or blocking of your PLAYSWEEPS Player Account:
 

5.15.1.   Information regarding the status of pending Request Cards will not be available until the review, approval, and crediting of Request Cards is complete;
 
5.15.2.   PLAYSWEEPS will be unable to provide updates on the status of Request Cards until the review is complete;
 
5.15.3.   All qualifying and approved Request Cards will be credited to the PLAYSWEEPS Player Accounts that meet the AMOE Request Card requirements described in these Official Rules;
 
5.15.4.   PLAYSWEEPS is only able to comment and advise on approved and credited Request Cards and is unable to provide information on invalid or rejected Request Cards;
 
5.15.5.   PLAYSWEEPS will only be able to respond to queries related to Request Card format if the Participant provides a picture or copy of their Request Card (PLAYSWEEPS will not provide a template or sample Request Card);
 
5.15.6.   Disqualified Request Cards will not be reconsidered; all decisions regarding Request Card approval are final;
 
5.15.7.   Any missing Request Cards or Request Cards that do not reach PLAYSWEEPS will not qualify for approval;

 

5.16.   A Participant’s Sweeps Coins balance will be displayed on the app screen in their Sweeps Coins Wallet on both the Standard Social Gameplay mode and the Sweeps Play game mode. Sweeps Coins may only be used in Sweeps Play mode. 
 
5.17.   A Participant will be able to see both their total, unplayed, and redeemable Sweeps Coins balances by clicking their Sweeps Coins Wallet while on the PLAYSWEEPS Platform. Only Sweeps Coins earned while playing games in Sweeps Play may be redeemed for prizes or cash.
 
5.18.   Use of any automated or other system(s) to participate in Sweeps Play mode, to acquire Sweeps Coins, or win prizes is prohibited and will result in disqualification from playing games on PLAYSWEEPS. To opt-out of PLAYSWEEPS Sweeps Play, a Participant need only play Standard Social Gameplay mode and not play in Sweeps Play mode.
 
5.19.   Sweeps Coins are only valid for sixty (60) days from the date a Participant last logged on to their PLAYSWEEPS Player Account. In the event that a Participant does not log onto his/her PLAYSWEEPS Player Account and experiences a balance change for sixty (60) consecutive days, all accrued Sweeps Coins shall automatically expire and the Player Account will be deemed Dormant in accordance with the PLAYSWEEPS Terms of Use.
 
5.20.    In the event of a dispute as to any registration of a Player Account, the authorized account holder of the email address used to register the Player Account will be deemed to be the owner of the Player Account. The “authorized account holder” is the natural person assigned the email address by an internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address.
 
5.21.   Sweeps Coins may be forfeited if a Participant's PLAYSWEEPS Player Account is deactivated for any reason at PLAYSWEEPS's sole discretion, or for any other reason also at PLAYSWEEPS's sole discretion

5.22.    Participants and/or potential winners may be required to provide proof of identification and eligibility as required by Sponsor. If it is discovered or suspected that a Participant has registered or attempted to register for the Sweepstakes using multiple identities, all of that Participant’s entries will be declared null and void and any prize such Participant might have been entitled to win will not be awarded to and may be revoked from such Participant. Any form of entry other than those described herein is void. Using an automated system to participate in the Sweepstakes or attempting to subvert the Sweepstakes entry process is also prohibited and may result in disqualification. Sponsor is not responsible for incorrect or inaccurate transcription of entry information, computer, online or human error, technical malfunctions, any omission, interruption, defect, or any other error, including, without limitation, lost, late, incomplete, invalid, illegible or misdirected entries, all of which may constitute grounds for disqualification in Sponsor’s sole and absolute discretion. If a problem occurs in the entry process, the entrant is solely responsible for verifying that the entry process has been validly completed. Sponsor shall have no obligation to advise an entrant of an incomplete entry. All entries become the sole and exclusive property of Sponsor and will not be acknowledged or returned. Entrant is responsible for all online charges incurred with any Internet service provider and/or wireless carrier.

 

6.         HOW TO WIN PRIZES WITH SWEEPS COINS AND VERIFICATION OF POTENTIAL WINNERS
 

6.1.    To win Prizes in PLAYSWEEPS Sweeps Play, a Participant must accumulate Sweeps Coins by playing Games in Sweeps Play. Participants may elect to play games in Sweeps Play mode by using Sweeps Coins as described above while on the PLAYSWEEPS Platform.

6.2.    Sweeps Coins used in Sweeps Play will be withdrawn from the Participant's unplayed Sweeps Coins balance in their Sweeps Coins Wallet. Sweeps Coins must be played a minimum of one (1) time to be eligible for redemption.

6.3.    All Sweeps Coins won while playing Games in Sweeps Play will be added to the Participant's redeemable Sweeps Coins balance.

6.4.    In the event that a Participant uses Sweeps Coins in Sweeps Play but their unplayed Sweeps Coins balance is insufficient to cover the minimum amount required for play, the additional Sweeps Coins needed to reach the minimum will be withdrawn from the Participant's redeemable Sweeps Coins balance and those Sweeps Coins will be deemed unplayed and may not be returned to the Player’s redeemable Sweeps Coins balance. In the event that there is a technical issue with a spin, the spin will be voided and all Sweeps Coins played in that spin  will be returned to the player in their unplayed Sweeps Coins balance.

6.5.    Once a Participant accumulates a minimum of 100 redeemable Sweeps Coins, they are eligible to submit a Redemption Request for redeem via ACH. Once a Participant accumulates a minimum of 50 redeemable Sweeps Coins, they are eligible to submit a Redemption Request for a gift card through Prizeout. To submit a Redemption Request, a Participant must select  the redeem button on the app screen. When a Participant hits redeem, a drop-down menu will appear where they can select to request Sweeps Coins redemption for a gift card or cash.

6.6.    If a Participant elects to submit a Redemption Request for a gift card, they will be redirected to a third-party site called Prizeout (described below). Once on Prizeout’s site, the Participant will be able to select from a variety of gift cards. A Participant's redeemable Sweeps Coins balance will be visible to them on the Prizeout site. A Participant can select which gift card they would like to submit a Redemption Request for, and then select the amount of redeemable Sweeps Coins they would like to use for the gift card (minimum 50 Sweeps Coins). If the Redemption Request is approved, the Participant will receive an email to the email address associated with their Player Account containing the gift card. Sponsor may charge a fee for processing of redemptions, in Sponsor’s sole discretion. Such fee if applicable shall not exceed the reasonably estimated costs of the payment processing.

6.7.    If a Participant elects to submit a Redemption Request for cash by selecting the “redeem via ACH” option, a number of verified payment options will appear for the Participant to select how they would like to receive their redemption. If the Redemption Request is approved, the Participant will receive a notice of the approval and  instructions to complete the redemption. Sponsor may charge a fee for processing of redemptions, in Sponsor’s sole discretion. Such fee if applicable shall not exceed the reasonably estimated costs of the payment processing.

6.8.    FOR PURPOSES OF REDEMPTION ONLY. One Sweeps Coin will be redeemable for One Dollar ($1.00). Sweeps Coins possess no real monetary value until a Redemption Request has been approved and processed by PLAYSWEEPS. There is no guarantee that a Redemption Request will be granted. Approval of Redemption Requests is at the sole discretion of PLAYSWEEPS.

6.9.    The odds of winning a certain number of Sweeps Coins will be available to Participants in each individual Game's Pay Table and Rules. These are the same odds the games possess in Standard Social Gameplay and the odds are the same whether the Sweeps Coins used in the Game were obtained through AMOE requests, as a free bonus to a purchase of Gold Coins, or any other promotional method.

6.10.   PLAYSWEEPS reserves the right to change the prize win rates and odds of any Game on the PLAYSWEEPS Platform, including both Standard Social Gameplay and Sweeps Play. It is a Participant's responsibility to check the rules of each Game they play to see the odds of winning while playing that particular Game.

6.11.    POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR. SPONSOR’S DECISIONS AS TO THE ADMINISTRATION AND OPERATION OF THE SWEEPSTAKES, ANY CHANGES TO THESE OFFICIAL RULES, AND THE SELECTION OF POTENTIAL WINNERS IS FINAL AND BINDING IN ALL MATTERS RELATED TO THE SWEEPSTAKES.

 

7.         PRIZE CONDITIONS:
 

7.1.    Prizes may only be obtained by redeeming redeemable Sweeps Coins obtained while playing Games in Sweeps Play.

7.2.    To be eligible to receive a Prize:

 

7.2.1.         A Participant must be an eligible Participant in accordance with these Official Rules; and

7.2.2.         The Participant's details must match those of the Participant's PLAYSWEEPS Player Account.

 

7.3.    security reasons and for the prevention of money laundering, Sponsor will only authorize a redemption of prizes to a bank or bank account held in the Participant's name. If you provide account details which relate to a bank account held jointly between you and another person, you acknowledge and accept that any prizes will be paid into that joint account, and you may be required to supply additional documentation relating to the person who jointly holds the bank account with you so that Sponsor may identify and verify the joint account holder.

7.4.    Sponsor is not responsible for any taxes or fees associated with a winning prize. Participants are responsible for all applicable taxes and fees associated with prize receipt and/or redemption. A Participant's total annual winnings will be made available upon request.

7.5.    Sponsor is not responsible for any foreign exchange transaction fees, charges or related costs may be incurred as a result of, or in relation to, a prize redemption, including but not limited to any losses or additional costs arising from foreign exchange fluctuations.

7.6.    Sweeps Coins are not transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. PLAYSWEEPS reserves the right to substitute the listed Prize of equal or greater value for any reason owing to circumstances outside PLAYSWEEPS’ reasonable control. Sweeps Coins may not be sold or transferred, nor offered for sale, substitution, or transfer, in any manner.  Sweeps Coins may only be used for gameplay in Sweeps Play.

7.7.    Prize winners will be notified in accordance with Section 6 of these Official Rules.

7.8.   Participants who elect to redeem Sweeps Coins for cash can do so through any of our approved payment processing methods after their redemption is approved. Participants who elect to redeem their Sweeps Coins through Skrill will receive their redemption instantly upon approval by PLAYSWEEPS.

7.9.   Participants who elect to redeem their Sweeps Coins through Prizeout will receive their redemption instantly upon completing the necessary steps to redeem through Prizeout. All gift card Prizes will be provided by Prizeout, a third-party sweepstakes company. For more information on Prizeout, see https://prizeout.com/. By redeeming Sweeps Coins for a gift card, Participants agree to be bound by all Prizeout rules, regulations, and Terms of Service. PLAYSWEEPS is not responsible for any delays in receiving a gift card prize or other disputes that may arise out of a gift card Prize provided through Prizeout.

7.10.   For Participants who reside and/or access PLAYSWEEPS Sweeps Play in the State of Florida or the State of New York, the maximum amount a prize may be redeemed is limited to $5,000 USD per spin or per play round. Any amounts in excess of $5,000 USD will not be eligible for redemption. Additionally, PLAYSWEEPS reserves the right to limit total daily redemptions to $10,000 USD in all States or Provinces.

7.11.    Sponsor will carry out additional verification procedures for any single or cumulative of Prizes valued at $600 or more, and Sponsor reserves the right to carry out such additional verification procedures in the case of a request to redeem any amount. Additional verification procedures may, for example, include requests for and examination of copies of Participant’s identification documentation (including photo identification) such as SSN, passport and proof of address such as a utility bill.

7.12.   Where any identification, credit or other verification check that Sponsor requires cannot be completed to its satisfaction because Participant has not provided any document Sponsor may request in the form that Sponsor requires  30 days of the date the document was first requested, the redemption request will be rejected and deemed null and void. In addition, PLAYSWEEPS shall be under no obligation to continue with the verification check and may in its sole discretion deactivate such Participant’s Player Account.

7.13.   It is the Participant's responsibility to ensure all bank and account information is correct and that the bank identified by Participant will accept and process payments from PLAYSWEEPS; and to ensure all information provided by Participant such as your legal name, address, age, and contact information is accurate and complete.

7.14.   PRIZES ARE AWARDED AS IS AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. SOME JURISDICTIONS MAY NOT ALLOW (OR MAY LIMIT) DISCLAIMERS OF CERTAIN WARRANTIES, IN WHICH CASE THE FOREGOING DISCLAIMERS WILL BE ENFORCED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

7.15.   ALL FEDERAL, STATE, PROVINCIAL, TERRITORIAL AND LOCAL TAXES AND FEES ARE THE SOLE RESPONSIBILITY OF THE PRIZE WINNER. ALL OTHER COSTS AND EXPENSES RELATED TO ANY PRIZE NOT SPECIFIED HEREIN AND OTHER EXPENSES INCURRED BY ACCEPTING THE PRIZE ARE ALSO THE SOLE RESPONSIBILITY OF THE WINNER. ANY REQUIRED TAX REPORTING FORMS WILL BE FURNISHED TO THE APPROPRIATE AUTHORITIES.

7.16.   Some third-party providers of Games restrict the use of their games from certain U.S. states and Canadian Provinces (each, as applicable, a “Provider Restricted Territory”).  Sponsor will use commercially reasonable efforts to ensure that Participants  are blocked from playing Games from a Provider Restricted Territory.  However, if a Participant is playing a Game in Sweeps Mode from within a Provider Restricted Territory and wins a Prize, the Sponsor, in its discretion, may void that Prize.

 

8.         PUBLICITY:
 

8.1.    where prohibited or restricted by law, a Participant’s acceptance of a Prize constitutes the Participant’s agreement and consent for Sponsor and any of its designees to use and/or publish their full name, city and state of residence, photographs or other likenesses, pictures, portraits, video, voice, testimonials, biographical information (in whole or in part), and/or statements made by the Participant regarding the Sweepstakes or Sponsor, worldwide and in perpetuity for any and all purposes, including, but not limited to, advertising, trade and/or promotion on behalf of Sponsor, in any and all forms of media, now known or hereafter devised, including, but not limited to, print, TV, radio, electronic, cable, or World Wide Web, without further limitation, restriction, compensation, notice, review, or approval. 
 
8.2.    By entering the Sweepstakes, entrants may be sharing their personal information with Sponsor. Personal information collected by Sponsor will be used for administration of the Sweepstakes and awarding the Prize. In addition, by entering, entrants agree to Sponsor’s use of entrant’s personal information as described in its privacy policy available HERE. Please refer to Sponsor’s privacy policy for important information regarding the collection, use and disclosure of personal information by Sponsor. Sponsor is not responsible for disclosures made by any third party. Entrants may subsequently opt-out of receiving further emails as set forth in Sponsor’s privacy policy.
 
8.3.    BY ENTERING THIS SWEEPSTAKES, YOU ACKNOWLEDGE AND AGREE THAT YOU HAVE READ AND CONSENT TO SPONSOR’S PRIVACY POLICY AND TERMS OF SERVICE.
 
8.4.    ENTRANT FURTHER ACKNOWLEDGES THAT ENTRANT’S PERSONAL IDENTIFYING INFORMATION MAY BE DISCLOSED TO THIRD PARTIES INCLUDING, WITHOUT LIMITATION, PLACING ENTRANT’S NAME ON A WINNERS’ LIST.

 

9.         GENERAL CONDITIONS: 
 

9.1.    Sponsor is not responsible for programming, coding, or other web production errors and Sponsor may rescind, cancel or revoke the Sweepstakes based on any such error without liability at its sole and absolute discretion. Sponsor also reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor, at its sole and absolute discretion.

9.2.    Sponsor also reserves the right, at its sole and absolute discretion, to disqualify any individual they find to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner.

9.3.    ANY ATTEMPT BY YOU OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE THE APPLICATION OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

9.4.    Participants agree to be bound by the Official Rules and decisions of Sponsor and/or Sponsor’s representatives, which are final and binding in all respects. Submitted entry materials become the sole property of Sponsor and will not be acknowledged or returned. The failure of Sponsor to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism (or threat thereof), act of public enemies, actions of governmental authorities outside of the control of Sponsor or other force majeure event will not be considered a breach of these Official Rules.

9.5.    The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. In the event that any provision of the Official Rules is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision. You agree to waive any rights to claim ambiguity of these Official Rules or any Sweepstakes materials. Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the documents or any provision hereof.

 

10.   LIMITATIONS ON LIABILITY:
 

10.1.    Sponsor and the Sweepstakes Affiliates and any and all Internet server(s) and internet and cellular telephone and mobile data access provider(s), and each of its respective companies, affiliates, subsidiaries, franchisees, partners, and all of their owners, officers, directors, members, managers, employees, representatives, and agents (collectively, “the Released Parties“) are not responsible for: any incorrect or inaccurate entry information; human errors; technical malfunctions; failures, omissions, interruptions, deletions or defects of any telephone network, computer online systems, computer equipment, servers, providers or software, including without limitation, any injury or damage to Participant’s or any other person’s computer or mobile device relating to or resulting from participation in the Sweepstakes; inability to download the Application or access any pages thereof; theft, tampering, destruction or unauthorized access to, or alteration of, entries; data that is processed late or incorrectly or is incomplete or lost due to telephone, computer, mobile telephone or electronic malfunction or traffic congestion on telephone lines, mobile telephone networks, or the Internet or any website or for any other reason whatsoever; typographical, printing or other errors; late, lost, stolen, mutilated, misdirected or postage-due mail, or any combination thereof. Any and all entry materials will become the property of the Sponsor and will not be acknowledged or returned. False, fraudulent or deceptive entries or acts shall render entrants ineligible. By entering the Sweepstakes, entrants affirm that they have read and accepted these Official Rules.

10.2.     Released Parties shall not be liable to Participants or any other person for failure to supply the Prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulation(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond the Released Parties’ sole control.

10.3.      By entering this Sweepstakes, entrants agree that Released Parties shall not be liable for personal injuries, death, dismemberment, damages, expenses or costs or losses of any kind resulting from participation in this Sweepstakes, or from acceptance of or use or inability to use a prize or parts thereof, including without limitation, claims, suits, injuries, losses and damages related to personal injuries, death, dismemberment, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light (whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. Each Participant who receives a Prize releases the Released Parties from any and all liability and responsibility with respect to the prize (including any property loss, damage, personal injury or death). Each Participant who receives a Prize acknowledges the aforementioned individuals and entities have neither made nor are in any manner responsible for any warranty, representation or guarantee, expressed or implied, in fact or in law, related to the prize.

 

11.   CONTROLLING LAW AND JURISDICTION:
 

11.1.       THE BELOW CHOICE OF LAW AND JURISDICTION (INCLUDING THIS ARBITRATION AGREEMENT AND WAIVERS) DOES NOT DEPRIVE ENTRANTS OF THE PROTECTION UNDER MANDATORY STATUTORY PROVISIONS THAT CANNOT BE WAIVED UNDER THE LAW WHICH WOULD HAVE OTHERWISE BEEN APPLICABLE.

11.2.       U.S. RESIDENTS: In the case of entrants who are legal residents of one (1) of the fifty (50) states in the United States or the District of Columbia, (excluding Connecticut, Idaho, Michigan, Montana, Nebraska, Nevada, North Dakota and Washington, whose residents are ineligible to enter the Sweepstakes), all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of an entrant in this Sweepstakes, and any action related thereto shall be governed by and construed in accordance with the internal laws of the United States of America and the State of Nevada. Subject to, and without in any way limiting, the “Dispute Resolution and Arbitration” provision set forth in the Terms of Service, the exclusive jurisdiction and venue of any action with respect to the subject matter of these Official Rules will be the state and federal courts located in the District of Nevada and each of the parties hereto waives any objection to jurisdiction and venue in such courts.

 

12.  DISPUTE RESOLUTION AND ARBITRATION
 

12.1.   YOU AGREE THAT, EXCEPT AS PROVIDED BELOW, OR EXPRESSLY PROVIDED IN A SEPARATE WRITTEN AGREEMENT BETWEEN YOU AND PLAYSWEEPS, ANY AND ALL DISPUTES (AS DEFINED IMMEDIATELY BELOW) BETWEEN YOU AND PLAYSWEEPS WILL BE DETERMINED IN BINDING ARBITRATION BEFORE THE AMERICAN ARBITRATION ASSOCIATION (“AAA”) OR IN SMALL CLAIMS COURT, INSTEAD OF COURTS OF GENERAL JURISDICTION.  FOR THE PURPOSE OF THIS DISPUTE RESOLUTION AND ARBITRATION PROVISION, “PLAYSWEEPS” MEANS PLAYSWEEPS AND ITS PARENTS, SUBSIDIARIES, AND AFFILIATE COMPANIES, AND EACH OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS.  YOU AND PLAYSWEEPS AGREE THAT THE U.S. FEDERAL ARBITRATION ACT (“FFA”) GOVERNS THE INTERPRETATION AND ENFORCEMENT OF THIS ARBITRATION PROVISION AND ALL DISPUTES.  YOU AND PLAYSWEEPS ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.    
 
12.2.    The term "Dispute" means any dispute, claim, or controversy between you and PLAYSWEEPS regarding any aspect of, or arising out of,  your relationship with PLAYSWEEPS, including your use of the Applications and/or the Service, and/or this Agreement, whether based in contract, statute, regulation, ordinance, tort (including, but not limited to, fraud, misrepresentation, fraudulent inducement, or negligence), or any other legal or equitable theory, and includes the validity, enforceability or scope of this Dispute Resolution and Arbitration Provision (with the exception of the enforceability of the Multi-party Proceedings clause below). "Dispute" is to be given the broadest possible meaning that will be enforced.
 
12.3.      Before either you or PLAYSWEEPS initiates arbitration or a small claims court proceeding to resolve a Dispute you and  PLAYSWEEPS each agree to send to the other party a written notice that describes in detail the Dispute and the relief sought (“Notice”) to allow the parties to attempt to resolve the dispute informally.  The Notice should include your preferred mailing address and email address and should be sent by U.S. Mail. You agree to send your Notice to PLAYSWEEPS Legal Department, 10150 Covington Cross Drive, Las Vegas, Nevada 89144.  Any Notice to you from PLAYSWEEPS will be sent the email address associated with your App account. 
 
12.4.     Your Notice must include (1) your name, (2) your address, (3) your support code or player ID and email address used to establish your game account (so that Sponsor can verify that you are a player of one or more of our Applications); (4) a written description of your claims or allegations that provide sufficient specificity for us to understand the Dispute and attempt to revolve it, and (5) a description of the specific relief you seek. If your initial Notice does not provide sufficient detail about your Dispute for a reasonable person to understand the specifics of your Dispute, PLAYSWEEPS may ask for additional information and you agree to provide such additional information.
 
12.5.       A Notice by PLAYSWEEPS must include (1) a written description of its claims or allegations that provide sufficient specificity for You to understand the Dispute and attempt to resolve it, and (2) a description of the specific relief it seeks.  Our notice to you will be sent to you based on the most recent contact information that you provide us.  However, if no such information exists or if such information is not current, then Sponsor has no obligation under this section.

12.6.        If the Dispute is not resolved within each agree to negotiate any Dispute between us in good faith.  You and PLAYSWEEPS each agree that neither may initiate 60 days after the later of the date that the initial Notice is received, or a supplemental notification is provided after responding to a request for additional information, either party may pursue the Dispute in arbitration or a small claims court proceeding unless the parties have made a good faith effort to resolve the Dispute through the informal dispute resolution procedure. 
 
12.7.        For Disputes that the parties cannot resolve within the time period set forth above, despite those good faith efforts, either you or PLAYSWEEPS may start arbitration or small claims proceedings.  The arbitration of all Disputes will be in binding arbitration before an arbitrator from the American Arbitration Association (“AAA”) and administered by the AAA under its Consumer Arbitration Rules in effect at the time the arbitration commenced, which are available at www.adr.org.  This Dispute Resolution and Arbitration provision governs in the event it conflicts with the applicable AAA rules.  The arbitrator will apply applicable substantive law consistent with the Federal Arbitration Act and the applicable statute of limitations.
 
12.8.       If the Dispute asserted in any request or demand for arbitration could have been brought in small claims court, then either you or PLAYSWEEPS may elect to have the Dispute heard in small claims court, rather than in arbitration, at any time before the arbitrator is appointed, by notifying the other party of that election in writing.  The claim must be brought (i) in the small claims court in your county of residence, and if your county does not have a small claims court, then the small claims court closest in proximity to your residence, or (ii) in small claims court in Clark County Nevada. Any dispute about whether a Dispute qualifies for small claims court will be resolved by that court, not by an arbitrator.  In the event of any such dispute, the arbitration proceeding will remain closed unless and until the small claims court issues a decision that the Dispute should proceed in arbitration.
 
12.9.      The arbitration of any Dispute will be conducted by a single arbitrator.  The arbitrator is bound by this Agreement.  EXCEPT AS OTHERWISE PROVIDED HEREIN, ALL ISSUES ARE FOR THE ARBITRATOR TO DECIDE, INCLUDING JURISDICTIONAL AND ARBITRABILITY ISSUES, AND THE FORMATION, EXISTENCE, VALIDITY, INTERPRETATION, AND SCOPE OF THIS DISPUTE RESOLUTION AND ARBITRATION PROVISION​.  
 
12.10.    All arbitration hearings will be conducted in Las Vegas, Nevada except that you can choose to have an arbitration hearing conducted in the federal judicial district nearest the mailing address you provided in your Notice.
 
12.11.     The arbitrator shall issue a reasoned written decision sufficient to explain the essential findings and conclusions on which the award is based.  The arbitrator may award, on an individual basis, any relief that would be available pursuant to applicable law, and will not have the power to award relief to, against, or for the benefit of any person who is not a party to the proceeding. The award shall be binding only among the parties and shall have no preclusive effect in any other arbitration or other proceeding involving a different party.  PLAYSWEEPS will not seek to recover its attorneys’ fees and costs in arbitration from you unless the arbitrator finds that either the substance of your Dispute or the relief sought in your demand for arbitration was frivolous or was brought for an improper purpose (as measured by the standards set forth in Federal Rule of Civil Procedure 11(b)).  Judgment on any award may be entered in any court having jurisdiction.  This arbitration provision shall not preclude any party to the arbitration from at any time seeking injunctions or other forms of equitable relief in aid of arbitration from a court of appropriate jurisdiction, including whether an arbitration demand is filed in violation of this Agreement.
 
12.12.      Unless PLAYSWEEPS or you seek to have a Dispute resolved in small claims court, the arbitrator shall determine all issues of liability on the merits of any Dispute asserted by you or PLAYSWEEPS and may award declaratory or injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party’s individual Dispute.  To the extent that you or PLAYSWEEPS prevail on a Dispute and seek public injunctive relief (that is, injunctive relief that has the primary purpose and effect of prohibiting unlawful acts that threaten future injury to the public), the entitlement to and extent of such relief must be litigated in a civil court of competent jurisdiction and not in arbitration. The parties agree that litigation of any issues of public injunctive relief shall be stayed pending the outcome of the merits of any individual Disputes in arbitration.  Before a court of competent jurisdiction issues any public injunctive relief, it shall review the factual findings of the arbitration award on which any injunction would issue with no deference to the arbitrator
 
12.13.      Payment of all filing, case management, and arbitrator fees will be governed by the AAA rules.  If you are a consumer who initiates arbitration against PLAYSWEEPS, PLAYSWEEPS will reimburse you for any filing fee at the conclusion of the arbitration to the extent it exceeds the fee for filing a complaint in a federal or state court in your county of residence.  If the arbitrator finds that either the substance of your Dispute or the relief sought in your arbitration demand was frivolous or was brought for an improper purpose (as measured by the standards set forth in Federal Rule of Civil Procedure 11(b)), then the payment of all fees will be governed by the AAA rules and PLAYSWEEPS will not reimburse your initial filing fee.  
 
12.14.     PLAYSWEEPS will not seek to recover its attorneys’ fees and costs in arbitration from you unless the arbitrator finds that either the substance of your Dispute or the relief sought in your demand for arbitration was frivolous or was brought for an improper purpose (as measured by the standards set forth in Federal Rule of Civil Procedure 11(b)).
 
12.15.     YOU AND PLAYSWEEPS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING, OR FOR THE BENEFIT OF A NON-PARTY (for purposes of these Terms of Service, these types of claims and actions will be referred to as a “Class Action”).  If you or PLAYSWEEPS have elected arbitration, unless both you and PLAYSWEEPS agree otherwise, the arbitrator may not consolidate any other person’s Dispute with your or PLAYSWEEPS’s Dispute and may not otherwise preside over any form of a Class Action, and you and PLAYSWEEPS each expressly waive the right to do so.  If you or PLAYSWEEPS believes that any Dispute that the other has filed in arbitration or in court is inconsistent with this paragraph, then you or PLAYSWEEPS may seek an order from a court determining whether the other’s Dispute is within the scope of the limitations set forth in this paragraph.  If a court or an arbitrator determines that any of the agreed upon limitations set forth in this paragraph is unenforceable with respect to any Dispute, remedy, or request for relief, then the unenforceable limitation will not apply to that Dispute, remedy, or request for relief.  But the remaining limitations will still apply to all other Disputes, remedies, and requests for relief that you or PLAYSWEEPS may assert in that or any other action.  In any such case, you and PLAYSWEEPS agree that the parties will arbitrate all Disputes, remedies, and requests for relief subject to individual arbitration first, and that any remaining unresolved Disputes, remedies, or requests for relief may be pursued in court only after the arbitrator’s award has been issued.  In any such proceeding, the arbitrator’s factual findings will not be entitled to deference by the court.  The parties agree that any statutes of limitations applicable to the unresolved Disputes, remedies, or requests for relief shall be tolled pending the outcome of any individual Disputes in arbitration.
 
12.16.    YOU MAY OPT-OUT OF THE FOREGOING DISPUTE RESOLUTION  AND ARBITRATION PROVISIONS BY NOTIFYING PLAYSWEEPS IN WRITING WITHIN THIRTY (30) DAYS FROM THE DATE THAT YOU FIRST CONSENT TO THIS AGREEMENT. YOU MUST SEND SUCH WRITTEN NOTIFICATION TO ATTN: PLAYSWEEPS LEGAL DEPARTMENT, 10150 COVINGTON CROSS DRIVE, LAS VEGAS, NEVADA 89144 AND INCLUDE (1) YOUR NAME, (2) YOUR EMAIL ADDRESS AND MAILING ADDRESS, AND (3) A CLEAR STATEMENT INDICATING THAT YOU DO NOT WISH TO RESOLVE DISPUTES THROUGH ARBITRATION AND DEMONSTRATING COMPLIANCE WITH THE 30-DAY TIME LIMIT TO OPT-OUT.  ANY OPT-OUT RECEIVED AFTER THE 30-DAY TIME LIMIT TO OPT-OUT WILL NOT BE VALID AND YOU WILL BE REQUIRED TO PURSUE YOUR DISPUTE PURSUANT TO THESE DISPUTE RESOLUTION AND ARBITRATION PROVISIONS.  
 
12.17.      Notwithstanding the foregoing or any other terms to the contrary, IN THE EVENT A DISPUTE ARISES OR HAS ARISEN BETWEEN YOU AND PLAYSWEEPS THAT IS NOT ARBITRATED FOR ANY REASON, YOU AGREE THAT SUCH DISPUTE will be resolved individually, without resort to any form of class action.
 
12.18.     Severability. If any part of this Dispute Resolution and Arbitration Provision (other than the Class Action waiver above) is held invalid, then that part may be severed from this Dispute Resolution and Arbitration Provision, and the remainder of this Dispute Resolution and Arbitration Provision will be given full force and effect.
 
12.19.     Survival of Dispute Resolution and Arbitration Provision. This Dispute Resolution and Arbitration Provision shall survive the termination of your use of the Applications or any part of the Service.
 

13.   One Year Claims Limitations Period.  YOU AGREE THAT REGARDLESS OF ANY STATUTE OR LAW TO THE CONTRARY, ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATED TO USE OF THE APPS OR THESE TERMS MUST BE FILED WITHIN ONE (1) YEAR AFTER SUCH CLAIM OR CAUSE OF ACTION AROSE (AND RECOVERY SHALL BE LIMITED TO THAT ONE-YEAR PERIOD) OR BE FOREVER BARRED.
 

14.   WINNERS’ LIST/OFFICIAL RULES:

 

For an Official Winners’ List required by applicable state law (first name, first initial of surname and state/country of winner only), available after the Sweepstakes Entry Period, or a copy of these Official Rules, send a self-addressed, stamped envelope (residents of Vermont only may omit return postage) to 10150 Covington Cross Drive, Las Vegas, NV 89144, Attn: Winners’ List or Official Rules (please specify which you are requesting). Official Rules are also available during the Sweepstakes Entry Period through the App. Requests for an Official Winners List must be received no later than three (3) months after the end of the Sweepstakes Entry Period, and must include the relevant state for which you are requesting the list.
If you object to any or all of your name or county being published or made available, please contact the Sponsors at sweepstakes@playstudios.com. In such circumstances, the Sponsor will still provide this information to US regulators on request
